Ticket Policy for All Ticket Holders
A. All ticket holders are subject to the standard ticketback terms and conditions (the "Ticketback Terms"), which are located here and incorporated herein by reference and made a part hereof. In the event there is a conflict between any of these Ticket Policies and the Ticketback Terms, the Ticket Policies shall govern except where noted herein.
B. The official account holder of tickets, for season tickets or otherwise, is the name or company that appears on the first line of the account contact. Example:
------------------------------------------------------------------------
XYZ Company
Attn: John Smith
1234 Main Street
New Orleans, LA 70123
(Company is the ticket holder)
------------------------------------------------------------------------
Mr. John Smith
c/o XYZ Company
1234 Main Street
New Orleans, LA 70123
(The individual is the ticket holder)
------------------------------------------------------------------------
Any changes made to a ticket account can be made only by the ticket holder of record. In the case of a company, the individual's name appearing on the second line of the account contact will be deemed to be the company's designated representative for the account. Verification of identity will be required for certain transactions, including, but not limited to, change of address, seat additions or deletions, lost or stolen ticket matters, and seat location changes.
C. Tickets are revocable licenses. The Saints reserve the right to revoke such licenses, in their sole discretion, at any time and for any reason. The Saints may cancel an account for reasons including, but not limited to:
- Stadium construction and/or reconfiguration of seating areas
- Changes in Saints Ticket Policies
- Failure to meet payment deadlines
- Drunkenness or disorderly behavior
- Scalping or improper resale of tickets
- Habitual misconduct
- Club relocation
- Violation of the NFL's Fan Code of Conduct
- Fraud, chargebacks, or use of counterfeit, duplicated, or altered tickets
- Unauthorized commercial activity, including promotions, sweepstakes, or giveaways involving tickets with Saints' prior written consent
D. Payments for tickets must be in the form of cash, check, or credit card (Visa, MasterCard, American Express, or Discover). If tickets are stolen, the ticket holder must present an official police report with a request to reissue. By providing a payment method, the ticket holder authorizes the Saints to charge all amounts due. The ticket holder agrees not to make or allow any chargeback except in cases of actual fraud, and authorizes the Saints to recover any chargeback amounts, chargeback fees, and related costs, including reasonable attorneys' fees, as additional amounts owed.
E. Each ticket holder agrees to release the Saints from any liability related to ticketing and their account, including but not limited to, lost, stolen, duplicate, damaged, or misplaced tickets; relocation of seats in a new stadium or in a modified Caesars Superdome; or, in the case of season ticket accounts, the number of games included within any Saints season ticket package. Further, should the Saints, for any reason, not play their home games in the Caesars Superdome, the ticket holder expressly agrees not to institute legal proceedings against the Saints, and that the Saints have no legal liability therefore. In the event of a cancellation or relocation of any game as a result of an act of God, a strike or other labor disturbance, damages to or destruction of the seats or stadium, or for any other reason whatsoever, the ticket holder's sole remedy shall be to seek a refund of the ticket price of the game(s) so canceled or relocated.
F. Notwithstanding anything to the contrary in these Ticket Policies, should a court of proper jurisdiction declare that the release herein is invalid or inapplicable for any reason or that the Saints are in default with respect to its obligations arising out of or in connection with the ticket account and its terms and conditions, the Saints' total liability to the ticket holder shall not exceed an amount equal to the cost of the ticket(s). It is expressly understood that the ticket holder waives the right to seek damages and injunctive relief sought in connection with the obligations arising out of or in connection with the ticket(s) and its terms and conditions or otherwise concerning the relationship between the Saints and the ticket holder. In no event shall the Saints be liable for any incidental, consequential, or punitive damages. The limitations and exclusions in this Section F apply to the maximum extent permitted by applicable law.
G. The Saints may issue tickets in digital-only form and may utilize dynamic barcodes and other anti-fraud features. The Saints may limit or restrict ticket transfers, resales, or postings, including by disabling transfer functionality, to the extent permitted by law.
H. Except as otherwise required by applicable law, tickets may not be resold or offered for resale on stadium grounds or in violation of stadium rules or applicable law. The Saints may, to the extent permitted by law, cancel any ticket or account, refuse admission, or revoke future purchasing privileges if tickets are resold or offered for resale in violation of these Ticket Policies, the Ticketback Terms, or applicable law.
I. The Saints and the ticket holder agree to attempt in good faith to resolve all claims, disputes, and controversies of any nature arising out of or in connection with the ticket account or otherwise concerning the relationship between the Saints and the ticket holder, whether arising in contract, tort, or otherwise (collectively "Dispute"), promptly by negotiation between their authorized executives. If any Dispute has not been resolved by negotiation as described above within sixty (60) days from the commencement of the negotiations, the parties shall first attempt to settle the Dispute by non-binding, confidential mediation in a mutually agreed upon location with a mutually acceptable mediator. If unsuccessful, the Dispute shall be submitted to and finally decided by binding arbitration administered by the American Arbitration Association under its Comerical Arbitration Rules. Venue for any arbitration proceeding shall be a reasonable location within Jefferson Parish, Louisiana. The arbitration shall be conducted on an individual basis only; class, collective, consolidated, or representative proceedings are not permitted. The arbitrator shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement, including any claim that all or any part of this arbitration agreement is void or voidable. Judgment on the award may be entered in any court having jurisdiction. If a court determines that the class action waiver is unenforceable as to certain claims, then those claims shall proceed in court and the remaining claims shall proceed in arbitration.Â
J. These Ticket Policies and any Dispute shall be governed by the laws of the State of Louisiana, without regard to conflicts of law principles, and, for any claims not subject to arbitration, the exclusive venue and jurisdiction shall be the state and federal courts located in Jefferson Parish, Louisiana, and the parties consent to personal jurisdiction therein.
K. Please note that other guidelines and policies may also apply to your game day experience, such as the Ticketback Terms and the NFL's Fan Code of Conduct and other regulations as well as those of the Caesars Superdome. Please check the Saints and Caesars Superdome websites periodically to see these regulations as they are subject to change.
L. Ticket holders acknowledge and agree that the Saints are permitted to collect, store, process, modify, transfer, disclose, delete, and/or use ticket holder personal information and data, in any form or medium, for administrative and marketing purposes in accordance with the Saints’ privacy policy, which is available on the Saints' official website.
M. If any provision of these Ticket Policies is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.
Ticket Policy for Season Ticket Holders
In addition to the Ticket Policy for All Ticket Holders, Saints season tickets account holders ("Season Ticket Holders") are subject to the following additional terms and conditions:
A. A request to transfer season tickets will be handled on a case-by-case basis, subject to the Saints' transfer policies and procedures, and proof of government-issued photo identification will be required. Should a request to transfer be approved, all rights and privileges associated with being a Season Ticket Holder will be transferred. Please note that a purported transfer by any other means is not valid and will not be honored, and the Saints reserve the right to cancel the account.
B. The Saints may cancel a Season Ticket Holder account for reasons including, but not limited to, Season Ticket Holder disputes. In the event of a dispute, the Saints may, but are not obligated to, place the account on hold, restrict transfers, and/or require the disputing parties to resolve their dispute before reactivating account privileges.
C. Any Season Ticket Holder account not renewed by the date listed on any applicable invoice will forfeit the rights to the seats on the account. Once seats have been reassigned to another account, it will not be possible to retrieve them. All season ticket sales are final after the second invoice due date. Further, each season ticket account is subject to the following fees: $8 per account handling fee and $100 for NSF checks.
D. The purchase of season tickets is on a per-season basis only and does not entitle the purchaser to renewal in a subsequent year. Payments for season tickets must be received by the Saints no later than the due date listed on the invoice(s) -- NO EXCEPTIONS. Except as otherwise provided herein, no refunds, seat relocations, or exchanges will be issued after payment.
E. When the Saints host a Wild Card, Divisional Playoff, or Conference Championship Game, Season Ticket Holders will be offered the opportunity to buy playoff tickets for each season ticket they own (same seating locations). Season Ticket Holders must purchase the complete playoff package or opt-in to the Pay-As-We-Play program in order to retain their seating location for the postseason. Any balance remaining from un-played games can be transferred to next year's season ticket balance, if renewed. Season Ticket Holder requests are filled before playoff tickets go on sale to the general public. Seat locations are subject to change due to stadium configuration, league requirements, or other operational needs.
F. If a Season Ticket Holder elects to participate in the automatic renewal of their season tickets, the terms and conditions found here shall apply. By enrolling in auto-renewal, the Season Ticket Holder authorizes recurring charges to the designated payment method for the amounts and on the schedule disclosed in the auto-renewal terms, until cancelled in accordance with those terms and applicable law.
G. The Saints may from time to time offer opportunities for upgrades or relocations, which are discretionary and subject to availability and criteria established by the Saints.
