North Endzone Club Season Ticket Terms and Conditions

A.Any changes made to a North Endzone Club account can be made only by the person who signed the North Endzone Club Seat Saints Ticket Agreement ("Agreement"). Request to Transfer season tickets will be handled on a case by case basis, subject to the transfer policies and procedures.Should a Request to Transfer be approved, all rights and privileges associated with being a season ticket holder will be transferred. Please note that a purported transfer by any other means is not valid and will not be honored, and the Saints reserve the right to cancel the account.

B. Payment Form.Payments for season tickets must be in the form of cash, check, Saints-approved third party payment processor, or credit card (Visa, MasterCard, American Express, or Discover). Payments must be received by the Saints no later than the due date listed on the Agreement. NO EXCEPTIONS.

C. Playoffs.When the Saints host a Wild Card, Divisional Playoff, or Conference Championship Game, season ticket holders will be offered the opportunity to buy playoff tickets for each season ticket they own (same seating locations). Season ticket holders must purchase the complete playoff package or opt-in to the Pay As We Play program in order to retain their seating location for the postseason. Any balance remaining from unplayed games can be transferred to next year's season ticket balance, if renewed. Season ticket holder requests are filled before playoff tickets go on sale to the general public.

D. Release of Liability.The season ticket holder agrees to release the Saints from any liability related to ticketing, including but not limited to, lost, stolen, duplicate, damaged, or misplaced tickets; relocation of seats in a new stadium or in a modified Mercedes-Benz Superdome; or the number of games included within any Saints season ticket package. Further, should the Saints, for any reason, not play their home games in the Mercedes-Benz Superdome, the season ticket holder expressly agrees not to institute legal proceedings against the Saints, and that the Saints have no legal liability therefore.

E. Force Majeure. In the event of a cancellation or relocation of any game as a result of an Act of God, a strike or other labor disturbance, damages to or destruction of the seats or stadium, or for any other reason whatsoever, the season ticket holder's sole remedy shall be to seek a refund of the ticket price of the game(s) so canceled or relocated.

F. Severability. Notwithstanding anything to the contrary contained in this document, should a Court of proper jurisdiction declare that the Release herein is invalid or inapplicable for any reason or that the Saints are in default with respect to its obligations arising out of or in connection with the Agreement or all related terms and conditions, the Saints liability to the season ticket holder shall not exceed an amount equal to the cost of the season tickets. It is expressly understood that the season ticket holder waives the right to seek damages and injunctive relief sought in connection with the obligations arising out of or in connection with the Agreement, all related terms and conditions, or otherwise concerning the relationship between the Saints and the season ticket holder.

G. Dispute Resolution. The Saints and the season ticket holder agree to attempt in good faith to resolve all claims, disputes, and controversies of any nature arising out of or in connection with the Agreement, all related terms and conditions, or otherwise concerning the relationship between the Saints and the season ticket holder, whether arising in contract, tort, or otherwise (collectively "Dispute"), promptly by negotiation between their authorized executives. If any Dispute has not been resolved by negotiation as described above within sixty (60) days from the commencement of the negotiations, the parties agree that prior to attempting to resolve the Dispute by arbitration, they shall attempt to settle the Dispute by non-binding, confidential mediation in a mutually agreed upon location by a mutually acceptable mediator. If unsuccessful, the Dispute shall be submitted to and decided by arbitration under the rules of the American Arbitration Association. Venue for any arbitration proceeding shall be a reasonable location within Jefferson Parish, LA.
